OpenAI Settles Hiring Discrimination Case for $3.2 Million

OpenAI is paying $3.2 million to settle federal allegations regarding its hiring practices. The Justice Department investigation found that the company and its subsidiary, Statsig Inc, used recruitment tactics that unfairly limited job opportunities for American citizens. Officials noted that some roles were not advertised publicly, and other hiring processes created barriers for qualified US applicants.

The settlement includes a $1.2 million civil penalty and a $2 million fund to compensate those affected by these hiring practices. In addition to the payments, OpenAI must undergo mandatory training and submit to ongoing oversight regarding its future hiring procedures.

A spokesperson for OpenAI stated that the company disagrees with the findings from the Justice Department. However, they chose to settle the matter to resolve the conflict and continue its PERM program, which helps staff members obtain immigration support. The company maintains that global recruitment is still a key part of its operational goals.

This case marks the 13th time the Justice Department has taken action under a specific program designed to stop citizenship discrimination in the workplace. While the investigation focused on fewer than ten specific positions, the outcome highlights the strict federal rules against favoring foreign visa holders over local candidates.
