Crypto custodian BitGo is facing legal pressure as multiple law firms issue alerts regarding an approaching August 7 deadline. The cutoff specifically applies to investors who want to step forward as lead plaintiffs in a securities class action filed against the company. The lawsuit, known as Arsenault v. BitGo Holdings, was filed on June 8 in the US District Court for the Eastern District of New York.

The complaint argues that BitGo and its executives downplayed how vulnerable the business was to declining digital asset prices during its public offering. Plaintiffs claim the company prospectus failed to properly explain the severe impact that crypto market volatility could have on financial performance. BitGo previously went public earlier this year alongside other major crypto firms, joining a wave of new stock market listings.

Despite the claims, BitGo did include warnings in its IPO prospectus about its exposure to digital asset prices. The company later posted a 60.7 million dollar loss in the first quarter, driven largely by unrealized asset losses and dropping staking revenue as token prices fell.

Shareholders should note that acting by August 7 is only necessary for those who want to oversee the litigation as a lead plaintiff. Regular investors do not need to take action right now, as separate deadlines for financial recovery could appear later if the case moves forward. Traders should watch how this legal battle unfolds and monitor broader sentiment around newly public crypto companies.
