Senate Majority Leader John Thune shared a cautious outlook on the Digital Asset Market Clarity Act this week. He stated that the Senate is unlikely to pass the bill before the chamber leaves for its long August recess. While negotiators had hoped for a vote by August 7, Thune suggested the goal now is simply to get the conversation started on the floor before members head home.

The legislation is designed to create a clear legal foundation for crypto in the United States by dividing regulatory oversight between the SEC and the CFTC. Although the Senate Banking Committee approved the bill with a 15 to 9 vote in May, moving the process into September significantly lowers its chances. With the upcoming midterm elections in November, floor time for new legislation is expected to become very limited.

Optimists like White House crypto adviser Patrick Witt remain hopeful that the window has not completely shut. However, even if a vote happens, the bill faces an uphill battle to secure the 60 votes required for passage. At least seven Democrats have already voiced opposition to the current draft, pointing to concerns regarding ethics and other provisions. Traders should watch for any movement on the Senate floor in early August to see if the bill can gain enough momentum to survive the fall session.
